Your Privacy Rights

(Consent to (1) processing sensitive personal data and (2) transfer outside the EEA)

Akin Gump Strauss Hauer & Feld LLP and its associated entities (collectively “Akin” or the Firm or “we”) are committed to protecting your privacy while providing you with the opportunity to receive our services.

This Privacy Notice describes your privacy rights regarding the collection, use, storage, sharing and protection of your personal information by Akin. It applies to the collection of your personal information via our alumni website entitled Akin Alumni Network linked to this Privacy Notice (the "Website").

Scope
By using this Website, you acknowledge and understand that Akin will process (including, but without limitation, collecting, storing, using, transferring or disclosing) any personal information that you submit.  You also expressly consent to Akin’s processing sensitive information you elect to submit (for instance, information relating to your race or ethnic origin or your religious beliefs or other beliefs of a similar nature).

By providing personal information via this Website, you acknowledge and understand the terms of this Privacy Notice.

We may amend this Notice at any time by posting a revised version on our Website. The revised version will be effective as of the published effective date. In addition, if the revised version includes a substantial change, we will provide you with 30 days’ prior notice by posting notice of the change on this Website. After this 30-day notice period, you will be considered as having expressly consented to all amendments to this Privacy Notice. If you do not agree to the changes, please contact us to deactivate your account.

Reason for processing and how we use the Personal Information

We process personal data in relation to the Website to enable Akin and Alumni to engage with its Alumni Network for the following legitimate business reasons:

  • to promulgate a sense of an Akin Alumni community;
  • to keep in contact with Alumni, and allow other Alumni to contact each other, for networking purposes;
  • the administration of the Website;
  • to deal with your enquiries and requests;
  • the continuation of Akin’s business and the provision of legal services;
  • the provision of information regarding our Firm and offices, and on the services, seminars, publications, the Firm’s marketing information, and all other similar information and/or materials offered by our Firm;
  • to carry out research about our alumni demographics and interests;
  • sending of newsletters, legal updates, and all other similar information and/or materials offered by our Firm;
  • to determine programming and events of interest;
  • consolidation of information relating to our clients and vendors among Akin offices; and
  • matters incidental to the purposes of use set out above, where permitted by applicable local law.


All these reasons are in the legitimate interests of Akin.

Collection of Personal Information
We collect the following types of personal information when you visit or use the Website:

Information we collect automatically: When you visit the Website, we (including service providers working on our behalf ("service providers")) may collect information sent to us by your computer, mobile phone or other access device. The information sent to us includes, but is not limited to, the following: your computer IP address, date and time of access, page accessed and input parameters, user account, information about the device accessing our system and its operating system, browser, and screen resolution.

Information you provide to us: We (including service providers) may process (as described in this Privacy Notice) any information you provide us when you use the Website, including:

  • Contact information, such as your name, address, phone, email, and other similar information;
  • Work and non-work-related experience, including current and previous; and
  • Education and Interests

Information from Other Sources: We also may obtain information about you from other sources, to the extent permitted by applicable law, such as through your contact with us, including from third parties such as employment research firms, identity verification services, and other websites on the Internet (subject to such third party’s privacy policies). For example, access  certain personal information stored by third parties such as social media websites. The information we may receive varies by site and is controlled by that site. Akin may collect, store and use this information in accordance with this Privacy Notice.

How We Share Personal Information with Other Third Parties
Akin will not sell or rent your personal information to third parties for their marketing purposes without your explicit consent.

We may share your personal information with service providers, including IntraWorlds Inc., who at the present time will be hosting the Website for us and LexisNexis Legal & Professional who presently host our customer relationship management system.  Those providers are obligated to protect your personal information consistently with the terms of this Privacy Notice. We may share your personal information with members of the Akin corporate family to assess your skills for job openings or analyze your need for Akin’s legal services. Access to your personal information will be limited to those employees or agents of Akin who have a business need to access such personal information.

How We Use Cookies and Similar Technologies
This Website uses “cookies” to facilitate the site user’s use of the site.  These are “session cookies” and are erased when you close your browser (unless the user clicks the “remember me” box so that the website will remember the user on a later occasion).   Akin uses Google Analytics, which also sets cookies to gather information about how our site is used.  We do not receive information about individual site users from Google Analytics.  Google advises that Google Analytics cookies “do not collect personal data about website visitors.”  https://developers.google.com/analytics/resources/concepts/gaConceptsCookies.

Cross Border Transfers of Personal Information
Akin operates both inside and outside the European Economic Area (“EEA”). The data that we collect from you may be transferred to, stored and processed at a destination outside the EEA, including countries whose laws provide various levels of protection for personal data, not always equivalent to the level of protection that may be provided in your own country.

By using this Website, you expressly consent to our transferring of your personal information to our servers in the US (and also potentially to servers in Germany and/or the US relating to Intraworlds Inc.’s cloud based interview platform). Please note that if your personal information is transferred in this manner Akin is committed to adequately protecting your personal information as described in this Privacy Notice regardless of where the data resides and to providing appropriate protection for your personal information where such data is transferred across borders. 

Please note Akin operates the following technical and organisational security protocols wherever the personal information is transferred to:

  • State of the art firewalls, malware prevention and intrusion detection systems
  • ISO 27001 certification


How long do we keep your Personal Information?
We do not keep your personal information for any specific period but will not keep it for longer than is necessary for our purposes.  In general, we will keep your personal information for the duration of your membership in the Akin Alumni Network and for up to 18 months afterwards.  In considering how long to keep it, we will take into account its relevance to our business either as a record or in the event of a legal claim.

How You Can Access or Change Your Personal Information
You can review and edit your personal information at any time by logging in to your account and reviewing your account settings and profile. You can access, review, and change most of your personal information by logging into the Website. You must promptly update your personal information if it changes or is inaccurate. Upon your request, we will deactivate or remove your personal information from our active databases, although some information may be retained as permitted or required by applicable law.

To the extent permitted by applicable law, we may delete your personal information at any time without any reason. Therefore, please retain your own copy of the personal information provided to us.

Access to your Personal Information and other rights
We try to be as open as we reasonably can about personnel information that we process.  If you would like specific information, you may ask us informally.

In addition, you have a legal right to make a “subject access request”.  If you exercise this right and we hold personal information about you, we are required to provide you with information on it, including:

  • giving you a description and copy of the personal information;
  • telling you why we are processing it; and
  • if you make a subject access request and there is any question about who you are, we may require you to provide information from which we can satisfy ourselves as to your identity.


In addition to the subject access right, subject to statutory conditions, you may have a right to have your personal information rectified or erased or to object to its processing or have it restricted.
